1. SCOPE

1.1. These Terms of Use (“Terms”) govern the relationship between Jasmina Srpčič Izdelava Ročnih Izdelkov s.p., Jasmina Srpčič, Mala Cikava 9A, 8000 Novo mesto, Slovenia
(“we”, “us” or “Jasmina Srpčič”) and you, the user of this website.

1.2. The Terms apply to your use of the online store available at jessyherc.com (the “Store”), including the purchase of our products.

1.3. Through the Store, you may purchase handcrafted products (“Products”) and subscribe to our newsletter (“Newsletter”) to receive updates, news, and special offers.

2. USING THE STORE

2.1. You may use the Store if you accept these Terms and have access to the Internet and a compatible web browser.

2.2. All purchases made through the Store are subject to these Terms, especially Section 3 (“Terms of Sale”) and applicable laws. You will be asked to explicitly accept these Terms before completing an order.

2.3. Newsletter subscription is optional. By subscribing, you consent to receiving emails from us. You may unsubscribe at any time.

3. TERMS OF SALE

3.1. General

All Products offered in the Store are sold by Jasmina Srpčič Izdelava Ročnih Izdelkov s.p. in accordance with these Terms.

3.2. Placing an Order

To place an order, select the desired Product(s) and add them to your cart. You may continue shopping or proceed to checkout. By clicking “Buy now,” you submit a binding offer to purchase the selected Product(s) (“Order”) and authorize us to charge the selected payment method.

3.3. Order Confirmation and Contract Formation

After receiving your Order, we will send an order confirmation email.
This confirmation does not constitute acceptance of your offer.

A binding contract is formed only once the Product(s) have been dispatched to the delivery address provided.

If we are unable to fulfill your Order due to availability issues, technical problems, or other valid reasons, we will notify you promptly and issue a refund if payment has already been made.

3.4. Prices and Shipping

All prices shown include applicable taxes but exclude shipping costs, which are calculated at checkout. Products are shipped worldwide after payment is completed. Delivery times are estimates only.

3.5. Payments

We may offer various payment methods, which can change over time. Payments are processed via third-party providers, whose terms may apply. Invoices are issued electronically.

3.6. Pre-orders

Some Products may be available for pre-order. Payment may be collected at the time of ordering. Pre-orders can be cancelled at any time before shipment, with a full refund issued within 14 days. Estimated shipping dates are indicative only.

3.7. Customer Acknowledgment

By placing an Order, you confirm that you are legally capable of entering into a contract and that the information provided is accurate. We reserve the right to request additional information or decline an Order if inaccuracies are suspected.

All orders are shipped from Slovenia, EU.

Orders are dispatched within 3–5 business days.

European Union

Delivery within the EU usually takes 5–10 business days. All shipments include tracking.

United States

Orders to the US are shipped via FedEx Express and usually arrive within 5–10 business days.

All import taxes, tariffs, and customs duties are the responsibility of the buyer. Any additional charges imposed by US Customs must be paid by the customer upon delivery.

If the buyer refuses to pay the required import fees and the package is destroyed by US Customs, no refund will be issued.

Tracking is included with every order.

Rest of the world

Shipments outside the EU and the US are sent via Pošta Slovenije and typically take 2–3 weeks.
Tracking is provided for all international shipments.

All import taxes, tariffs, and customs duties are the responsibility of the buyer. Any additional charges imposed by the destination country must be paid by the customer upon delivery.

If the buyer refuses to pay the required import fees and the package is destroyed by customs, no refund will be issued.

Phone number
Please provide a phone number at checkout. It will be used exclusively for delivery purposes by the shipping carrier, if required.

3.8. Order Cancellation

Orders may be cancelled at any time before shipment by contacting us.

3.9. Right of Withdrawal

Unless stated otherwise, you have the statutory right to withdraw from your purchase within 14 days of receiving the Product(s), without providing a reason.

Returned Product(s) must be sent within 14 days to:

Refunds will be processed within 14 days after receipt of the returned Product(s). Standard outbound shipping costs will be refunded. Return shipping costs are borne by the buyer.

If returned items show signs of use or damage, a reduction in refund value may apply.

Withdrawal rights do not apply to:

  • Custom or personalised items

  • Items unsuitable for return due to hygiene reasons

  • Digital content delivered immediately with prior consent

  • Discounted or sale items

3.10. Defective Products

Please inspect Products upon delivery. If a Product is defective or incorrect, contact us promptly. Depending on the situation, we will offer a repair, replacement, or refund as required by law.

4. USER RESPONSIBILITIES

4.1. You agree to use the Store lawfully and not engage in any activity that is misleading, harmful, illegal, or disruptive.

4.2. You must not infringe the rights of third parties or upload unlawful content.

4.3. By submitting reviews, images, or other content (“User Content”), you grant us a non-exclusive, worldwide, royalty-free license to use such content for promotional and marketing purposes.

4.4. Linking to the Store is permitted provided it does not misrepresent or harm our brand.

5. INTELLECTUAL PROPERTY

All Products, designs, images, and content remain the intellectual property of Jasmina Srpčič Izdelava Ročnih Izdelkov s.p. Unauthorized use is prohibited.

6. FEEDBACK

Feedback and suggestions are welcome at jessyhercshop@gmail.com, though we are not obligated to implement or compensate for them.

7. TERMINATION

We reserve the right to restrict access to the Store or cancel orders if these Terms are materially breached.

8. SUPPORT AND DISPUTE RESOLUTION

8.2. Disputes should first be resolved informally within 30 days.

8.3. If unresolved, EU consumers may submit a complaint via the European Commission’s ODR platform.

9. PERSONAL DATA

Personal data is processed in accordance with our Privacy Policy.

10. FORCE MAJEURE

Neither party shall be liable for failure to perform due to events beyond reasonable control.

11. GOVERNING LAW

These Terms are governed by the laws of Slovenia. Courts of Slovenia have exclusive jurisdiction, without prejudice to mandatory consumer protections.

12. CHANGES TO TERMS

We may update these Terms when necessary. Updated Terms become effective 30 days after publication.
